The judge can use the information gathered as evidence of knowledge. It's obvious that HSBC knew of the links between Huawei and Skycom. And now it's obvious that the judge said most people know. I find it surprising that a bank wouldn't have a collective awareness of the corporate structure of its 17th largest customer. And as outlined by the evidence gathered they actually did know. This was in fact, what is referred to as " a hail Mary pass". If we can excuse ( in part) even a rough outline of fraud ( which to my mind is doubtful), there's still the two other points to make, the one being of political interference both from the Canadian government and.directly by comments made by the former US President. The assumption that his influence is gone is superfluous. He was at the time, the legitimate executive therefore political interference DID happen. But even if the judge decides to sideline that argument, the departure of Standard Operating Procedure by the RCMP and comments and contradictory statements made by RCMP and CBSA officials has to my mind compromised this case.
